These Terms of Service ("Terms") govern your use of CinematicCard (operated by Sid Carver, "we", "us", or "our") at cinematiccard.com. By using our service or making a purchase, you agree to these Terms.

1. Service Description

CinematicCard creates personalized digital greeting Cards with music, animations, calligraphy, photos, and personal messages. Cards are delivered as unique web links and optionally via email to your recipient.

2. Pricing & Payments

CinematicCard offers digital greeting cards at the following price tiers:

• Classic: $3.99 — includes calligraphy, animations, music, personal message, and a shareable link that never expires
• Premium: $6.99 — everything in Classic plus photos (up to 20) and custom music upload
• Signature: $9.99 — everything in Premium plus a built-in cash gift reveal (Venmo, PayPal, or CashApp)
• Optional scheduled delivery: +$1.00 on any tier

All prices are in USD. Payment is one-time per card. No subscription or recurring charges apply. Maximum charge per card: $10.99. Payments are processed securely by Stripe.

All sales are final. Due to the digital nature of the product, we do not offer refunds. However, if you experience a technical issue preventing your card from working, contact [email protected] and we will make it right. See our Refund Policy for details.

3. User Content

• You retain ownership of all content you upload (photos, messages, music).
• By uploading content, you grant CinematicCard a limited, non-exclusive license to use the content solely for the purpose of creating and hosting your card.
• You are responsible for ensuring you have the right to use any content you upload.
• Do not upload content that is illegal, harmful, threatening, abusive, defamatory, or infringes on others' rights.
• We reserve the right to remove content that violates these Terms without notice.

4. Intellectual Property

• CinematicCard's design, animations, code, and branding are our intellectual property.
• You may not copy, reproduce, or distribute our card templates, animations, or source code.
• The card you create is yours to share freely with anyone.

5. Card Availability

• We aim to keep card links active indefinitely.
• We reserve the right to remove inactive cards after 2 years without notice.
• We are not responsible for card availability during server maintenance, outages, or circumstances beyond our control.

6. Prohibited Use

You agree not to:

• Use the service for any unlawful purpose
• Upload malicious files, viruses, or harmful content
• Attempt to access other users' cards or data without authorization
• Abuse the service through automated requests, scraping, or excessive uploads
• Resell or commercially redistribute the service

7. Limitation of Liability

CinematicCard is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you for any claim is limited to the amount you paid for the specific card in question.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

9. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of CinematicCard after changes constitutes acceptance of the updated Terms.
